The Supreme Court Upholds the 2nd Amendment!

From the POLITICO:

"In a 5-4 decision Monday, the Supreme Court declared for the first time that the Second Amendment right to bear arms extends to states and local governments. The ruling opens the door to challenges to gun control laws and ordinances across the country."

It's literally stunning that it was a 5-4 decision rather than a 9-0 decision. Make no mistake, this was a vote on the 2nd Amendment, and 4 of the Supreme Court Justices chose to vote their PREFERENCE in favor of gun control, rather than vote according to the clear wording of the 2nd Amendment. To wit:

"...the right of the people to keep and bear arms shall not be infringed."

What part of that wording DON'T the 4 leftist Supremes understand? You see, it truly doesn't (or shouldn't) matter whether Justice Stevens or Ginsberg like or even dislike the 2nd Amendment at all. It shouldn't matter one bit if they believe in full-scale gun confiscation.
Their job is to apply the Constitution to these matters, NOT WRITE NEW LAW!!!!

That's what the legislature is for. Activist judges are clear and present danger to our constitution and our law-based society. In case you're wondering, this sort of behavior is at the very heart of conservative's objections to left-wing jurists.

  1. Any guesses about how the democrats feel about this ruling? Just a quick thought, I wonder if the democrats who soundly stand on the "stari decisis" position that the Supreme Court rulings are not to be revisited (because they want to keep roe v. wade in place forever)? I think we can guess that they will of course find some way to try to verbally diminish this ruling at some future point while still standing on their grounds abortion should remain.....

    I've looked a bit at some of the blogs and most dems/lefties don't like this, but they're not squealing TOO loudly because they understand this issue is political death for them.

  3. About "stari decisis." I think FAR too much is made of the concept. If decisions are made by the SC which blatantly contradict the Constitution or are seriously in question I have NO PROBLEM whatsoever revisiting those issues to bring them in line with the Founder's intent or a strict reading of the amendments.

    Roe V, Wade was bad law, no matter how you feel about the abortion issue. I have mixed emotions myself on the issue, not about the morality (it's abhorrent) but about making abortion illegal. Roe V. Wade was badly decided with improper precedents. "Emanations from Penumbras."
    God save us from garbage like that!

  4. I'm not surprised that the SCOTUS decision was a close one. Just look at the leftards we've got sitting on the bench there!

    We can celebrate this little victory for a time, but I'm thinking that the decision could well be overturned by a subsequent SCOTUS, one with more BHO adherents on the bench.

  5. AOW no doubt they'd like to try overturning this decision, but it's not as easy as writing legislation. The SC found on behalf of the clear wording of the 2nd Amendment. Reversing this one would be BLATANTLY violating the 2nd. Even with a Warren Court, they'd have a tough time justifying any decision to the contrary.

    Yet, it is STUNNING that 4 of them voted like they did...

  7. WHT this isn't the only thing we need to reverse! These people are doing damage at a BREAKNECK speed and I only hope that in 10 years we have regained our freedom to the point it was when Bush took office 10 years ago. Ideally we could turn it back (the individual freedom clock) to the year 1880. :-) It sure wasn't perfect, but government wasn't everyone's biggest threat at the time.
    Unless you were black, especially in the south. That was obviously an abomination against our founding.

  12. WHT I worked in the sun all day yesterday, and this summer is a HOT one! We had some days last week that were 94-99 degrees with 90% humidity. That's just friggin brutal! I think I was spoiled by the relatively mild summersa we've had the last 5-6 years...
